These Terms & Conditions (the “Terms”) form an agreement between you and Purepecha Enterprises, Inc. dba El Matador (“El Matador,” “we,” “us,” or “our”), a family-owned seasoning and food products company based in Woodridge, Illinois. They govern your use of matadorbros.com (the “Site”) and any products you buy from us.

Please read them carefully. By browsing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site or order our products.

01Who May Use the Site

You may use the Site and place orders if you are at least 18 years old and able to enter into a binding contract, or if you are using the Site under the supervision of a parent or guardian who agrees to these Terms. We currently sell and ship within the United States only.

02Changes to These Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page. Changes take effect when they are posted, and your continued use of the Site or placement of a new order means you accept the updated Terms. The version in effect when you place an order governs that order.

03Our Products, Ingredients & Allergens

We sell seasonings and food products intended for ordinary household use. Your health and safety matter to us, so please note the following:

• Always read the label. The ingredient statement, allergen information, net weight, and any handling or storage instructions on the product packaging are the authoritative source. Recipes and formulations can change, so the label on the product you receive controls over anything shown on the Site.
• Allergens. Our products are produced in facilities that also handle other foods and ingredients. If you have a food allergy or sensitivity, please review the label carefully before use and contact us with any questions before ordering.
• Storage and use. Follow the storage instructions on the package. Products should be kept sealed, dry, and away from heat and direct sunlight unless the label says otherwise.
• Not medical or dietary advice. Nothing on the Site is intended as medical, nutritional, or dietary advice, and our products are not intended to diagnose, treat, cure, or prevent any disease. Talk to a qualified healthcare professional about your specific dietary needs.

04Product Descriptions, Images & Availability

We work hard to describe our products accurately, but we do not warrant that descriptions, images, packaging, colors, or other content on the Site are complete, current, or error-free. Packaging and labeling may be updated from time to time, and screen colors may differ from the actual product.

All products are offered subject to availability. We may add, change, limit, or discontinue any product at any time without notice.

05Pricing, Taxes & Payment

• All prices are shown in U.S. dollars and do not include shipping or applicable sales tax, which are calculated and displayed at checkout before you confirm your order.
• Prices may change at any time, but a change will not affect an order we have already confirmed.
• Payments are processed by our third-party payment provider. We do not store your full card number on our systems. By submitting payment information, you confirm that you are authorized to use the payment method you provide.
• If a product or shipping price is listed incorrectly because of a typographical or system error, we may cancel or correct the affected order, even after it has been confirmed. If your order is cancelled for this reason and you have already been charged, we will issue a full refund.

06Placing an Order

When you place an order, you agree to provide accurate, complete, and current information, including a correct shipping address and a working email address and phone number so we can reach you about your order.

Your order is an offer to buy. The confirmation email you receive acknowledges that we got your order; a contract is formed when we accept the order and ship it. We may refuse, limit, or cancel any order — for example, if a product is out of stock, if we suspect fraud, if the information provided is incomplete or incorrect, or if the quantity ordered appears to be for resale without our agreement.

07Changes & Cancellations

We pack and ship quickly. If you need to change or cancel an order, contact us as soon as possible by phone, text, or email. We will do our best to accommodate the request, but once an order has been packed or handed to the carrier we may not be able to change it. In that case, our Refunds & Returns Policy applies.

08Shipping & Delivery

• We ship to the address you provide at checkout. Please double-check it — we are not responsible for delays, misdeliveries, or losses caused by an incorrect or incomplete address.
• Shipping times are estimates, not guarantees. Once a package is with the carrier, delivery timing is outside our control and may be affected by weather, carrier backlogs, holidays, and similar factors.
• If tracking shows your order as delivered but you cannot find it, please check with your household and neighbors and contact us so we can help.
• If your order arrives damaged, incorrect, or does not arrive at all, contact us. See our Refunds & Returns Policy for how we handle these situations.

09Returns, Refunds & Damaged Orders

Our Refunds & Returns Policy is part of these Terms and is incorporated by reference. In short: returns are accepted within 15 days of delivery on unopened items in original packaging; opened food products cannot be returned for safety reasons; damaged, defective, or incorrect orders are eligible for a refund or replacement; and discounted or promotional items are final sale. 10Promotions, Discount Codes & Sale Items

Discount codes, promotions, and giveaways may have their own rules, eligibility requirements, and expiration dates, which are part of these Terms when you use them. Unless we say otherwise, codes cannot be combined, have no cash value, apply only to eligible products, and may be modified or withdrawn at any time. We may void a discount or cancel an order if a code is used in a way it was not intended.

11Wholesale & Bulk Orders

Products bought through this Site are sold for personal, household use. If you would like to carry our products in a store, restaurant, or other business, or you need a large quantity, please see our Wholesale Orders page or contact us — wholesale orders are handled separately and under their own terms.

12Acceptable Use of the Site

You agree not to use the Site to do anything unlawful or harmful. Among other things, you may not:

• place fraudulent orders or use a payment method you are not authorized to use;
• scrape, copy, or harvest content, pricing, or images by automated means;
• attempt to gain unauthorized access to the Site, our systems, or another person’s data;
• upload viruses or other harmful code, or otherwise interfere with the operation or security of the Site;
• resell our products or use our name, logo, or content in a way that suggests an affiliation or endorsement we have not agreed to; or
• use the Site in violation of any applicable law or regulation.

We may suspend or refuse service to anyone who violates these Terms.

13Intellectual Property

The Site and its contents — including text, graphics, photographs, product descriptions, recipes, packaging designs, page layouts, and the El Matador name and logo — are owned by Purepecha Enterprises, Inc. dba El Matador or its licensors and are protected by copyright, trademark, and other laws.

You may view, download, and print pages from the Site for your own personal, non-commercial use. Any other use — including copying, reproducing, republishing, distributing, or creating derivative works — requires our prior written permission. Nothing on the Site grants you a license to any of our trademarks.

14Reviews, Photos & Feedback You Share

If you send us a review, recipe, photo, video, testimonial, comment, or suggestion — by email, text, social media, or any other channel — you give us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, adapt, and display it in connection with our products and marketing, with credit to your name or handle where it makes sense. You confirm that the content is yours to share and does not infringe anyone else’s rights. We are not obligated to use, keep confidential, or pay for anything you send us, and we may remove or decline to publish content at our discretion.

15Third-Party Websites & Services

The Site may link to, or rely on, services operated by others — for example, our payment processor, shipping carriers and label providers, and social media platforms. We do not control those services and are not responsible for their content, practices, or availability. Your use of a third-party service is governed by that provider’s own terms and privacy policy.

16Disclaimer of Warranties

We stand behind our products, and nothing in these Terms limits any rights you have under applicable consumer protection or food safety laws, or excludes any warranty that cannot legally be excluded.

Subject to that, the Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any defect will be corrected.

17Limitation of Liability

To the fullest extent permitted by law, El Matador and its owners, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or relating to the Site or our products, whether based in contract, warranty, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for any claim relating to a product or order is limited to the amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. Nothing here limits liability for fraud, personal injury, or death caused by our negligence, or for anything else that cannot be limited under applicable law.

18Indemnification

You agree to indemnify and hold harmless El Matador and its owners, officers, and employees from any claims, losses, liabilities, and reasonable attorneys’ fees arising out of your misuse of the Site, your violation of these Terms, or your violation of the rights of another person.

19Events Beyond Our Control

We are not responsible for any delay or failure to perform caused by events outside our reasonable control, including severe weather, natural disasters, fire, labor disputes, carrier or supplier disruptions, ingredient shortages, utility or internet outages, government actions, and public health emergencies.

20Privacy

Our Privacy Policy explains what information we collect when you order or contact us, how we use it, and the third-party providers we work with. It is part of these Terms, and by using the Site you agree to it.

21Resolving Disputes

We are a small family business and we would rather fix a problem than argue about it. If something goes wrong, please contact us first at elmatador@matadorbros.com or (708) 261-4813 and give us a chance to make it right. Both of us agree to try to resolve any dispute informally for at least 30 days before starting a formal proceeding.

22Governing Law & Venue

These Terms and any dispute arising from them or from your use of the Site or our products are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in DuPage County, Illinois, and you and we consent to the jurisdiction of those courts. Nothing here prevents either of us from bringing a claim in small claims court.

23General Terms

• Entire agreement. These Terms, together with our Refunds & Returns Policy and Privacy Policy, are the entire agreement between you and El Matador regarding the Site and your orders, and replace any earlier version.
• Severability. If any provision is found unenforceable, the rest of the Terms remain in effect and that provision will be enforced to the greatest extent permitted.
• No waiver. If we do not enforce a provision right away, we have not waived our right to enforce it later.
• Assignment. You may not transfer your rights under these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of our business.
• Headings. Section titles are for convenience only and do not affect interpretation.
